The centenary of Armistice
Day will take place on Sunday,
November 11, and the Otautau RSA
has organised a celebratory parade
to mark 100 years of peace. RSA
groups from Ohai-Nightcaps and
Drummond will also take part in the

at 10.30am where people will
gather at the war memorial and
be welcomed by Otautau RSA
president Brian Drummond. After
that there will be wreath laying
while a piper plays, followed by the
Last Post and flag lowering.

observed, with the old Presbyterian
Church bell ringing 11 times
One special moment on the day
would be the releasing of helium
balloons with a poppy seed inside
them, he said.
"We'll let the balloons be
released. They'll burst when they
get high and the seed will drop
somewhere over Southland.
"I think it will be good," he said.
Once the balloons are released,
there will be a rousing performance
by the Otautau Kapa Haka group.
"I think there 80 to 90 kids

A special exhibition to honour Southlanders
who fought, and died, in World War One, opened in
Invercargill last week.
The Armisitice Day exhibition will run for a limited time and will close on
Saturday, November 10.
Letters written by soldiers and historical documents
are all part of the new exhibition.

Christmas is just around the corner and the holiday season is near. This
brings forth a complicated area of employment law
– the Holidays Act 2003.
After six months’ continuous employment an employee becomes entitled to four weeks
annual leave. How this actually works, however, can vary in each case.
Example: Sophie works five days a week, Monday to Friday, 8.30am to 5pm. This work
pattern never changes. She is paid $20.00 per hour worked.
Easy. In the space of 12 months, Sophie accrues four weeks leave (28 days). If she takes
an annual leave day, she will be paid her normal working day and one day of annual leave
will be deducted.
Example: Daniel works fluctuating hours depending on the availability of work and is
paid $20.00 per hour worked. Sometimes he works Monday to Friday from 06.00am to
3.30pm, but other weeks he may work Monday to Friday 06.00am to 05.30pm.
Not so easy. This will require the employer to work out how his annual holiday is paid
based on whichever rate is higher of either:
a) Daniel’s ordinary weekly pay at the beginning of the annual holiday; or
b) Daniel’s average weekly earnings for the 12 months just before the end of the last pay
period before the annual holiday.
This means the employer will need to rely on timesheets and ensure they calculate the
accurate pay each time Daniel takes leave.
“Pay-as-you-go” holiday pay is where an employee receives 8% of their earnings in
addition to their pay each fortnight. The law is very strict in that you can only pay holidays
in this manner if the employee:
a) Is on a fixed-term employment agreement for less than one year; or
b) Is a casual employee and works so irregularly and intermittently that it is impracticable
to provide four weeks annual leave.
The consequences of paying your employee on an “as you go” basis when you shouldn’t,
is you may be ordered to pay them their entire annual leave accrual again (on top of the
8% you have already paid them!). This is because the Act places emphasis on employees
actually getting holidays as opposed to being “paid out” their holidays.
Employers need to ensure they are aware of their obligations under the Act and get
holidays for their employees right.
